UK Spouse Visa

If you are a British Citizen or you are settled in the UK, meaning that you have obtained Indefinite Leave to Remain(commonly referred to as ILR and also known as Permanent Residence then your Spouse or Partner will require a UK Spouse Visa to join you in the UK.

Qualifying Requirements

In order to submit a valid UK Spouse Visa application you must be able to meet the following requirements:

1. Your Relationship

1. You and your partner are both at least 18 years of age.
2. You are married and the marriage is valid under UK law. If you are not married then you must have been living together in a relationship akin to marriage for at least 2 years.
3. The marriage is genuine and subsisting.
4. You and your partner have met.

2. The Financial Requirement

You are required to demonstrate that you meet a minimum level of income or available savings. If you are applying outside the UK then only the British Citizen's income can be considered. If you are applying inside the UK then joint income can be considered. The minimum level of income is currently £18,600 per annum and this increases if you have children. Alternatively, or in addition to income, savings can be used to meet the requirement. If you cannot meet this requirement then you should not apply for a Spouse Visa.

The financial requirements can be quite complex, depending on your situation. Our Consultants have extensive experience with these applications and will be able to ensure that your application has the best possible chance of approval.

3. The English Language Requirement

The applicant must demonstrate that they have a minimum level of English language ability and this requirement can be bet by nationality, having a degree taught in English or an approved English language test. If you cannot meet this requirement then you cannot apply for a UK Spouse Visa.

4. Settlement - ILR for UK Spouse Visa Holders

After 5 years in the UK with Spouse Visa status you and your children should be able to apply for Indefinite Leave to Remain ILR Permanent Residence. Applicants who applied for a Spouse Visa prior to 8 April 2012 might qualify for Settlement after 2 years in the UK.

If your relationship ends then you may still be able to remain in the UK and qualify for ILR in due course depending on the length of time in the UK and how the relationship ended.

5. Can I apply for a Spouse Visa while I am in the UK?

If you are in the UK with a visitor visa or other visa granted for less than 6 months then you would usually be expected to leave the UK and submit your UK Spouse Visa application from your home country. In most other cases where you are in the UK with a visa granted for more than 6 months you should be able to submit your visa application from within the UK. If you are currently outside the UK then you should submit your Spouse Visa Application from your home course

Australia Spouse Visa

If you are married to an Australian Citizen, Permanent Resident or eligible New Zealand citizen, or have been in a defacto relationship (common law) with one for at least 12 months, you may be eligible for immigration by obtaining a Spouse Visa to Australia. Your spouse may sponsor you for a period of two years. After this, if the relationship is still genuine and continuing, you may be eligible for Permanent Residence.

Requirements

In order to be eligible for a spouse visa to Australia, you must fulfill the following requirements:

1. You and your spouse have a commitment to a shared life as husband and wife, whether or not you are legally married, to the exclusion of all others.
2. Your relationship is genuine and continuing.
3. You and your spouse live together, or don't live separately and apart on a permanent basis.
4. Unless you are legally married, you must have been in a spouse relationship for the last 12 months, which usually involves showing that you have lived together during this period
5. Generally, you both need to be aged 18 or over.
6. You must pass health and character criteria.

Rules and procedure

1. You may either be in Australia or overseas when applying for a spouse visa for Australia, although there are advantages to applying from within Australia. Please contact us for advice on obtaining a spouse visa.
2. Once your initial application is granted, you will be issued with an Extended Eligibility Temporary Visa. This will allow you to stay in Australia for two years and you will have full work rights during this period.
3. In some circumstances, it is not necessary to wait the two-year period before applying for permanent residence. This may happen if:

(a) You have been in the relationship with your spouse for five years or more at the time of application.
(b) You have been in the relationship for two years where there are dependent children of the relationship.
(c) Your spouse was granted a Permanent Visa under the humanitarian program or was granted a Protection Visa and was in the relationship with you before the visa was granted and this relationship was declared to Australian immigration officials at the time.

4. After the two-years period, you will be entitled to apply for Permanent Residence in Australia provided that your relationship still continues.
5. In some circumstances, you may be eligible for Permanent Residence even if the relationship has broken up before the end of the two-years period. These circumstances include:

(a) If your spouse has died during this period.
(b) If you and your Australian Spouse have children under 18 years of age.
(c) If you or your dependents have been subject to domestic violence during this period.

USA Spouse Visa

An appointment package is sent to the agent or the applicant. (See note below.) The appointment package gives the applicant an interview date and tells you the specific requirements of the visa. It includes instructions on where to go to have the required medical examination. During the interview process, an ink-free, digital fingerprint scan will be taken. Some visa applications require further administrative processing, which takes additional time after the visa applicant’s interview by a Consulate Officer. In general, the following is required
1. Passport(s) valid for six months beyond the intended date of entry into the United States
2. Birth certificate
3. Marriage certificate
4. Police certificate from all places lived since age 16
5. Medical examination
6. Evidence of financial support. A completed Form I-864 Affidavit of Support from petitioner/ sponsor is required.
7. Application for Immigrant Visa and Alien Registration, Form DS-230, both Part I and Part II
8. Two immigrant visa photos
9. Proof of the marriage and the husband/wife relationship
10. Payment of immigrant processing fees, as explained below

An applicant may bring marriage photographs and other proof that the marriage is genuine. Documents in foreign languages should be translated. The consulate officer may ask for more information

Take clear, legible photocopies of civil documents, such as Birth and Marriage Certificates, to the immigrant visa interview. Original documents can then be returned to you.

Note: The National Visa Center sends appointment packages to the agent for applicants in certain countries when the petitions are filed in the United States. The embassy or consulate sends appointment packages to applicants in all other countries. It also sends appointment packages to all applicants whose petitions are already at the embassy or consulate.
